24.11.2018 Oleksandr Ovchynnykov participated in the training on international arbitration in Duala (Cameroon)

On 21-23 November 2018, Oleksandr Ovchynnykov attended a training on international arbitration in Duala (Cameroon).

This training was organised by the International Association of Lawyers and the International Court of Arbitration of the ICC. In addition, the Cameroon Bar Association and the GICAM Arbitration Centre provided assistance to this event.

16.11.2018 Oleksandr Ovchynnykov participated in the conference on the reform of civil justice in Odessa (Ukraine)

On 16 November 2018, upon invitation by the Odessa Law Academy, Oleksandr Ovchynnykov spoke on the reforms adopted by the Council of Europe member states in the framework of the execution of judgments of the ECHR.

This conference was organised by the Odessa Law Academy in honour of Professor Chervoniy. Several judges, professors and lawyers participated in the conference.

Oleksandr Ovchynnykov commented in some detail the process of the execution of judgments of the ECHR. He also provided numerous examples of the civil justice reforms adopted by the Council of Europe member state following the ECHR judgments finding violations of the right to a fair trial.

On the same day Oleksandr Ovchynnykov spoke before the Law Academy students about the procedure before the ECHR.

13.09.2018 Oleksandr Ovchynnykov successfully represented a Turkish citizen in the proceedings relating to the return from France to Turkey of his child removed illegally from Turkey to France

Oleksandr Ovchynnykov successfully represented a Turkish father of a minor child removed illegally from Turkey to France by his mother in violation of the Turkish judicial decisions which provided the child custody to the father. Oleksandr first lodged an application with the French Central Authority who is discharging the duties imposed by the Convention of 25 October 1980 on the Civil Aspects of International Child Abduction. Then he intervened voluntarily on behalf of the father in the judicial proceedings instituted by the public prosecutor before the competent judge. By a decision of 13 February 2018,the judge has granted almost the totality of the father’s claims. In particular, the judge has ordered the immediate return of the child on the Turkish territory. This decision has been successfully executed. The father and his daughter have returned to Turkey.

Oleksandr Ovchynnykovrepresents regularly parents whose children have been illegally removed to other countries.

03.07.2018 ECHR rules in favour of O. Ovchynnykov’s client

On 3 July 2018 the European Court of Human Rights delivered a judgment in the case of Volokitin and Others v. Russia (application no. 74087/10 and 13 Others), in which it held that there had been a violation of Article 1 of Protocol No. 1 to the Convention in respect of all the applicants on account of the failure by the Russian authorities to redeem Soviet-era premium bonds.

Oleksandr Ovchynnykov acted in the proceedings before the ECHR as a representative of one of the applicants who claimed the most important just satisfaction (1 million Soviet Rubles, or 8,061,316 Euros).

The ECHR fully granted the applicant’s claim relating to the violation of his right under the Convention.

Moreover, the ECHR ruled that the Russian authorities shall take all the necessary measures with a view to executing the present judgment.

Oleksandr Ovchynnykov represents clients before the ECHR on a regular basis.

Oleksandr Ovchynnykov participated at a seminar on international justice in Beirut (Lebanon)

On 11 and 12 May 2018, Oleksandr Ovchynnykov participated at a seminar on the effectiveness of the role of international tribunals in upholding human rights in Beirut, Lebanon. This seminar was dedicated to the evaluation of the effectiveness of international tribunals, in particular international criminal courts, in protecting human rights. The seminar was also dedicated to the role played by lawyers in the functioning of those international tribunals.

The seminar was organised by the International Association of Lawyers, of which Oleksandr Ovchynnykov is member, in cooperation with the Beirut Bar.

Oleksandr Ovchynnykov participated in the round-table on the reopening of judicial proceedings following judgments of the European Court of Human Rights (ECHR) in the Supreme Court of Ukraine

On 22 February 2018, upon invitation by the managers of the Council of Europe project “Support to the Implementation of the Judicial Reform in Ukraine”, Oleksandr Ovchynnykov spoke before the judges of the Supreme Court’s Grand Chamber on the reopening of judicial proceedings following judgments of the ECHR.

Oleksandr Ovchynnykov commented in some detail the international standards in this matter. He also gave an interpretative analysis of the recent legislative modification to the Ukrainian procedural codes in light of these standards.

The seminar, which was organized by the European Union and the Supreme Court of the Republic of Turkmenistan, concerned the quality of judicial decisions.

The seminar, which was organized by the European Union and the Supreme Court of the Republic of Tajikistan, concerned the quality of judicial decisions in administrative, civil and criminal cases.

Oleksandr Ovchynnykov participated at a training seminar for Uzbek and Kazakh judges in Shymkent (Republic of Kazakhstan)

On 21 and 22 September 2017, Oleksandr Ovchynnykov participated as a lecturer at a training seminar for
Uzbek and Kazakh judges in Shymkent (Republic of Kazakhstan). The seminar, which was organized by
the European Union and the Supreme Court of the Republic of Kazakhstan, concerned the quality of
judicial decisions in administrative, civil and criminal cases.

During the two days of work, Oleksandr Ovchynnykov mainly focused on criminal procedure, in particular
regarding the requirements of fair trial, in accordance with international standards, notably the European
Convention on Human Rights.

Oleksandr Ovchynnykov on excessive length of pre-trial investigations and judicial proceedings at a second meeting of a specialized work group in Kyiv (Ukraine).

On 13 July 2017, upon invitation by the managers of the Council of Europe project “Support to the Implementation of the Judicial Reform in Ukraine”, Oleksandr Ovchynnykov participated in the second meeting of a work group tasked with the elaboration of an effective domestic remedy to accelerate judicial proceedings and/or obtain compensation for violations that had already occurred in Kyiv (Ukraine).

Oleksandr Ovchynnykov commented in some detail on the issue of legal instruments emanating from international organizations, which provide certain guidelines for the elaboration of an effective domestic remedy to accelerate judicial proceedings and/or obtain compensation for violations that had already occurred. He also actively participated in the discussion of the concept paper relating to the effective domestic remedy which had been prepared by a national expert of the project.

Oleksandr Ovchynnykov participated at an expert meeting on protection of lawyers’ rights and ethical standards of legal practice in Osh (Republic of Kyrgyzstan).

On 30 June 2017, upon invitation by the managers of the European Union project “EU-Central Asia Rule of Law”, Oleksandr Ovchynnykov participated at a working meeting of a round table on protection of lawyers’ rights and ethical standards of legal practice in Osh (Republic of Kyrgyzstan). The round table was jointly organized with the Paris and Kyrgyz Bars.

Oleksandr Ovchynnykov informed the participants of the round table about existing international standards around the protection of lawyers’ rights and ethical standards of legal practice. He also actively participated in the discussion about the most acute problems of the Kyrgyz Bar in the light of the above-mentioned international standards.

Oleksandr Ovchynnykov on excessive length of pre-trial investigations and judicial proceedings at a first meeting of a specialized work group in Kyiv (Ukraine).

On 23 March 2017, upon invitation by the managers of the Council of Europe project “Support to the Implementation of the Judicial Reform in Ukraine”, Oleksandr Ovchynnykov participated in the first meeting of a work group tasked with the elaboration of an effective domestic remedy to accelerate judicial proceedings and/or obtain compensation for violations that had already occurred. The work group was established pursuant to an order of the Ministry of Justice. It is composed of representatives of State agencies and civil society.

Oleksandr Ovchynnykov informed the members of the work group about existing international standards for judicial proceedings in reasonable time. He also provided the participants with examples of successful domestic remedies that had been introduced by certain member states of the Council of Europe.
